The Office of the New York State Attorney General ("OAG") recently completed an investigation of Managed Long Term Care Plan, VNS; and you were employed by a Licensed Home Care Services Agency ("LHCSA") (Intergen Health LLC ("Intergen"), and/or Amazing ("Amazing") Home Care Providers, Inc.) that contracted with VNS to provide home care services to VNS's members beginning February 1, 2015. In a prior investigation, OAG found that Intergen and Amazing failed to compensate home care aides appropriately when they experienced violations of 24-hour shift break policies. In this investigation, OAG found that alterations to the contracts between VNS and LHCSAs like Intergen and Amazing can ameliorate the issue of proper compensation by LHCSAs for aides working 24-hour shifts. VNS also contributed $500,000 to a fund to be distributed as restitution to aides who worked for Intergen and Amazing and who, in the opinion of the OAG, were adversely affected by Intergen and Amazing's actions. As a result of Amazing and Intergen's violations, you are owed money.
